Resident-to-Resident Nursing Home Abuse – Sample Case

The lawsuit:

Daughters of an 87 year old woman filed lawsuit against a Stark County, Ohio nursing home after their mother was struck by another resident causing her to fall to the ground and suffer a brain bleed that ultimately resulted in death.

What happened:

An 87 year old woman was admitted to the Alzheimer Unit of a Stark County nursing home for care. While a resident of the unit, she was struck by a male resident, causing her to strike her head and fall to the ground. She sustained a bleed to her brain and ultimately died from the brain bleed within six weeks of the attack. Her daughters retained Angela Vagotis and through her investigation, learned that the same resident had struck her client three months earlier but the family was never informed. In fact she was taken to the emergency department for treatment and her family was told she “fell”. The evidence showed that the nursing home had knowledge of the dangerous propensity of the offending resident and did not take any steps to remove him from the facility, in order to protect the other residents, until after he fatally struck the client.

Settlement: $350,000.00
